MILITARY SERVICE UNDER CONTRACT

Requirements for candidates when entering military service under a contract in the military units of the troops of the National Guard of the Russian Federation.

In accordance with Article 33 of Section V of the Federal Law of March 28, 1998 No. 53-FZ “On Military Duty and Military Service”, the requirements for citizens entering military service under a contract are established:

Activities for professional psychological selection are carried out by specialists in professional psychological selection in the manner determined by the Regulations on the procedure for military service. Based on the results of professional psychological selection, one of the following conclusions is made on the professional suitability of a citizen for military service under a contract in specific military positions:

  • recommended in the first place - the first category;
  • recommended - the second category;
  • conditionally recommended - the third category;
  • not recommended - the fourth category.

A citizen classified by the results of professional psychological selection to the fourth category of professional suitability cannot be accepted for military service under a contract.

A citizen entering military service under a contract, in addition to the above requirements, must also meet the requirements for the level:

In accordance with Article 34 of Section V of the Federal Law of March 28, 1998 No. 53-FZ “On Military Duty and Military Service”, a military service contract has the right to conclude:

  • military personnel whose previous military service contract ends;
  • military personnel undergoing military service by conscription and received before being called up for military service higher education, as well as conscripted military personnel who have served for at least three months;
  • citizens in the reserve;
  • male citizens who are not in the reserve and have received higher education;
  • female citizens who are not in the reserve.

Citizens aged 18 to 40 have the right to conclude the first contract for military service.

The basis for registering citizens as candidates is their applications submitted to military units, completed in accordance with paragraph 2 of Article 5 of the Regulations on the procedure for military service, approved by Decree of the President of the Russian Federation of September 16, 1999 No. 1237.

Military units register and accept for consideration applications from citizens who have expressed a desire to enter military service under a contract.

The commander of the military unit considers the accepted application and gives instructions on conducting a medical examination, measures for professional psychological selection, checking the compliance of the level of education, professional and physical training with the requirements established for those entering the military service under the contract.

The application of a citizen who has expressed a desire to enter military service under a contract may be returned by the commander of a military unit on the grounds provided for in paragraph 5 of Article 5 of the Regulation on the procedure for military service, approved by Decree of the President of the Russian Federation of September 16, 1999 No. 1237, on the following grounds :

  • in the absence of citizenship of the Russian Federation;
  • if, on the date of conclusion of the contract, his age does not meet the requirements of the Federal Law, and also if this person is not entitled, in accordance with the Federal Law, to conclude a contract;
  • in the event of a guilty verdict against him and the imposition of punishment, conducting in respect of his inquiry, preliminary investigation or transfer of a criminal case to court;
  • if he has an unexpunged or outstanding conviction for a crime;
  • if this person was serving a sentence of imprisonment;
  • if this person is subjected to administrative punishment for the consumption of narcotic drugs or psychotropic substances without a doctor's prescription or new potentially dangerous psychoactive substances (until the expiration of the period during which this person is considered to be subjected to administrative punishment).

Together with the application, in accordance with paragraph 3 of Article 5 of the Regulations, citizens present a document proving their identity and citizenship, and submit:

  • a completed and signed application form for entering the military service under a contract;
  • an autobiography written by one's own hand in free form;
  • duly certified copy of the work book (if any);
  • duly certified copies of documents confirming professional or other education;
  • duly certified copies of marriage certificates and birth certificates of children (if any);
  • two 3 x 4 cm photographs (for non-reserve citizens and female citizens only);
  • a photograph of 9 x 12 cm in size (the surname, name, patronymic and date of photographing are indicated in ink on its back; the photograph is certified by the commander of the military unit and the official seal of the military unit);
  • duly certified copy of the birth certificate;
  • extract from the house book.

A citizen may present a characteristic from the last place of work.

The grounds for refusing to conclude a contract with a candidate entering military service under a contract are:

  • the absence of vacant military positions in the military units of the troops of the National Guard of the Russian Federation according to the candidate’s training profile or the military registration specialty received by him;
  • the decision of the attestation commission of the military unit, approved by the commander (chief) of the military unit, on the conclusion of a contract for military service with another candidate based on the results of competitive selection;
  • the decision of the commission of the military commissariat or the attestation commission of the military unit on the non-compliance of the candidate entering the military service under the contract with the requirements established by this Federal Law.

A military service contract cannot be concluded with citizens who have been convicted and sentenced, who are under investigation or preliminary investigation or whose criminal case has been brought to court, citizens who have an unexpunged or outstanding conviction for committing offences, serving sentences of imprisonment.

If a citizen is refused to conclude a contract for military service, he has the right to appeal this decision to a higher authority, prosecutor's office or court.

What is the term for consideration of an application for admission to the service

The authorized person, within the period from one to three months from the date of acceptance of the application, conducts a procedure for verifying the data provided by the citizen, after which, if no questions arise, he gives a referral for psychophysical and medical examinations, as well as for the testing procedure for professional psychological selection.

In case of a delay in the process of verifying the identity of a citizen's data, he will be notified in writing. The maximum delay is 1 month.

He shall be notified of this in writing from the date of the decision.

For those who want to get into the Russian Guard, it will be interesting to know that the salaries of employees in the structure will be higher than those of ordinary military men, both for privates and officers. The average private and sergeant is from 19 to 90 thousand rubles. Officers have a slightly higher salary - from 45 to 120 thousand rubles. The amount may vary by region. They will pay extra for special conditions of service and various risks. Such a high salary is associated with dangerous work, because the fighters of this structure will fight against all types and manifestations of the terrorist threat.

The servicemen of the Russian Guard have a number of benefits, like other military personnel, but with some additions. Each employee in the structure will be provided with housing, and children will be taken to educational institutions out of turn and on preferential terms. Also, in the event of the loss of a breadwinner during service, the family of the deceased will be included in a special program of assistance to the families of the National Guardsmen.

Powers of the Guards

Compared to other paramilitary structures, the fighters of the National Guard have a number of exclusive powers. For example, the ability to use weapons without warning is allowed only in cases where delay would cost the life of a soldier or civilian. If there is no such threat, then the fighter must first warn about the use of firearms. Armored vehicles and water cannons are allowed to be used only in emergency cases, such as repelling an attack or when freeing hostages. During street protests that have turned into riots, fighters have the right to use force, using rubber batons, gas grenades, handcuffs and equipment to destroy barriers. Also, employees can check documents, detain citizens for a period of not more than three hours and draw up protocols of administrative violations. While conducting counter-terrorist operations, the Russian Guard can restrict traffic, use citizens' cars and detain people who violated the curfew.

In 2016, the President of Russia signed a decree on the creation of the National Guard. The official name itself was perceived by society ambiguously. What was the purpose of the National Guard

The purpose of the new structure is described in the previously mentioned presidential decree number 57, signed in April 2016. Currently, its formation has not yet been completed. The process should end at the end of this year. In general, the National Guard is created on the basis of the currently existing units involved in:

  • crimes related to the illegal circulation of weapons;
  • ensuring the security of various, both public and private facilities;
  • private security.

The guards will also include regional rapid reaction units and mobile units of the Ministry of Internal Affairs. An aviation unit will also be attached to it.

As it is easy to see, parts of the Ministry of Internal Affairs will become its backbone. The reorganization as a whole is designed to improve the interaction between disparate building blocks having the same goals, as well as to help increase their mobility.

A feature of the Russian Guard is that it reports directly to the President of the Russian Federation.

Tasks in progress

At present, the political balance in the world has been disturbed. Centers of power are changing, new hotbeds of tension are emerging almost every day. The sole dominance of the West is a thing of the past. In conditions of such increased turbulence in the external arena, which has led to profound changes in the format of communication between states and supranational structures, new solutions are required. There is a significant increase in the risk of many threats to Russia's security from various international groups, both terrorist and extremist.

In most cases, attacks on infrastructure facilities are carried out by small groups of fanatics. It is the confrontation with them that is the main task of the National Guard.

Her direct responsibilities include:

  • various anti-terrorist activities in any region of the country;
  • protection of significant infrastructure and life support facilities (including nuclear power plants);
  • interaction with other services to maintain order, protect the integrity of the country, protect borders.

The main factor that makes it possible to increase the efficiency of the newly created structure is a single centralized management. At the same time, departments at the regional level are removed from this function, which makes it possible to increase the speed of response to threats and in some cases ensure proper secrecy.

Requirements

Only the very best will be able to serve in the National Guard. The selection will be very thorough. First of all, it is planned to take young men who previously served:

  • in law enforcement agencies;
  • border guard;
  • army and other law enforcement agencies.

All of them must necessarily be citizens of Russia and have excellent health. Persons over the age of 31 will not be accepted into the service.
